Any person desiring to change their name may file a Petition requesting a name change with the circuit court in the county where they reside. A Judge will then determine if the change of name should be granted upon finding that the change is proper and not detrimental to the interests of any other person. If the change of name is approved by the Court, public notice of the change is required to then be provided three times in the newspaper.
A minor child's name may also be changed by Court Order. The Petition for Name Change of a minor child must be filed by the child's next friend or guardian. Both parents must provide their consent for the name change. If both parents do not provide their written consent, notice of the hearing and petition must be provided and proof of service submitted to the Court. Many Courts will not require a hearing if both parents have provided their written consent to the name change. Public notice must also be provided for the name change of a minor child.
